TERMS

●Scope of Application(Article 1)

  • Contract for accommodation and related agreements entered into by and between the Hotel and the Guest to be accommodated are subject to these terms and conditions and the provisions of House Regulations. Any particulars not stipulated herein and House Regulations shall be governed by the laws and regulations and/or generally accepted practices.
  • No legal right of residence shall accrue from any long-term accommodation.
  • These terms and conditions and House Regulations are subject to change without prior notice.

●Application for Accommodation Contract(Article 2)

  • Person intending to make an application for Accommodation Contract shall notify the Hotel of the following particulars before the date specified by the Hotel; tentative application is not accepted.
    An Accommodation Contract will be deemed to have been concluded upon acceptance of application by the Hotel.
    • Name, contact information, age, sex, nationality and occupation of each person to be accommodated;
    • Date of accommodation and estimated time of arrival;
    • Number of overnight stay(s):
    • Number of persons to be accommodated;
    • Name and contact information of the person making the application;
    • Name and contact information of the person paying the Accommodation Charges (based on the basic room charge shown in Annex 1); and
    • Other particulars deemed necessary by the Hotel.
  • The Hotel requires the following for request made by the Guest for extension of accommodation beyond the number of stay(s) in Paragraph (3) of the preceding clause. An extended accommodation may be rejected if the Guest fails to meet these requirements before the specified date:
    • Advance notification of changes in the date of accommodation and schedule; and
    • Advance payment of Accommodation Charges.
  • Any discrepancy in understanding between the Guest and the Hotel of particulars including the date of accommodation and details of application shall be treated as cancellation of Accommodation Contract set forth in Clause 1 of Article 10. The Hotel shall not be liable for any lost profits suffered by the Guest from such cancellation.
  • The Hotel may cancel an Accommodation Contract after it has been concluded, if it is determined that the application for Accommodation Contract does not conform to these terms and conditions and/or provisions of House Regulations or that the Guest is not suitable for accommodation.

●Security Deposit(Article 3)

  • The Hotel may request payment of security deposit upon acceptance of application for Accommodation Contract, within the limit of Accommodation Charges covering the entire length of stay.
  • Application for Accommodation Contract shall cease to be effective if the security deposit set forth in Clause 1 is not paid before the date specified by the Hotel.

●Registration(Article 4)

The Guest shall register the following particulars at the Hotel front desk on the day of accommodation:

  • Particulars set forth in Clause 1 of Article 2;
  • Nationality, passport number, place and date of entry to Japan (for non-Japanese);
  • Date and estimated time of departure; and
  • Other particulars deemed necessary by the Hotel.

●Payment of Accommodation Charges(Article 5)

  • Payment of Accommodation Charges covering the entire expected length of stay shall be made when checking in at the Hotel front desk, in Japanese currency or by debit card, credit card or other means of payment acceptable to the Hotel.
    Personal checks, however, are not accepted.
  • Any payment due to be made by someone other than the Guest but not paid before the specified date, will be charged directly to the Guest.
  • Accommodation Charges shall still be charged, even if the Guest voluntarily chooses not to stay after initiating occupancy of the contracted guest room.
  • In the case of accommodation package which includes meal(s) or additional services, charges for such meal(s) or additional services shall still be charged, even if the Guest voluntarily chooses not to take advantage of said services, etc.
  • Charges for various optional services other than basic Accommodation Charges, including food/beverage and parking, shall be paid in cash (in Japanese currency).
  • Occupancy of the contracted guest room outside of the occupancy hours set forth in Clause 1 of Article 6 shall be subject to the following extra charges; provided, however, that this applies only if any such out-of-hours occupancy is requested by the Guest in advance to the front desk and consented by the Hotel:

Extra Charges

  • 1,000 yen per person/hour(included tax)
  • Use of guest room after check-out time beyond 1:00 p.m.: one day’s Accommodation Charges (regular rate)

* Payment of extra charges shall be made in cash (in Japanese currency).

●Occupancy Hours, Safety and Hygienic Control(Article 6)

  • The Guest is entitled to use the contracted guest room on the arrival date from 3:00 p.m. (check-in time) to 11:00 a.m. (check-out time) on the following day.
  • Except as requested by the Guest and consented by the Hotel, the Guest is not entitled to occupy the contracted guest room outside of the hours set forth above, even during stay for consecutive days.
  • The Hotel may contact the guest room, access the guest room, or take other necessary measures for safety and hygienic control purposes even at hours during which the Guest is entitled to use the guest room or when the Hotel has consented to the use of the guest room, irrespective of any requests made in advance with respect to the stay.
  • The Hotel shall not be liable for any damage and/or lost profits suffered by the Guest from measures taken pursuant to the preceding clause.

●Baggage and Belongings in Guest Room(Article 7)

The Hotel will remove any baggage and belongings of the Guest left behind in the guest room after check-out.
Accommodation Charges (regular rate) will be charged in the event that the guest room is rendered unusable due to baggage and belongings left behind.
Accommodation Charges will still be charged even if a Guest due to be accommodated for consecutive days leaves baggage or belongings behind in the guest room but voluntarily chooses not to sleep overnight.

●Room Cleaning(Article 8)

  • If room key is not returned to the front desk at 11:00 a.m., the Hotel will contact the guest room to ascertain whether or not the room needs to be cleaned.
  • By placing a “Do Not Disturb” or “No room clean up today” sign on the door in the hallway, the Guest is deemed to have declined cleaning.
  • Provided, however, that guest rooms will be cleaned as required if the Hotel deems it necessary from safety and hygienic reasons.
    Furthermore, the Hotel shall be entitled to take such necessary measures as to contact or access the guest room.
  • Baggage and belongings in the guest room may be moved for cleaning, from hygienic control reasons.
    The Hotel assumes no responsibility for any stolen or lost articles not left at the front desk for safekeeping.
  • The Guest shall not be entitled to refuse the provisions of foregoing four clauses.
  • Requests regarding room cleaning, including whether or not room cleaning is requested, are accepted before 10:00 a.m. on the same day.
  • The Hotel shall not be liable for any damage and/or lost profits resulting from foregoing six clauses.

●Refusal of Accommodation Contract(Article 9)

The Hotel may not accept an application for Accommodation Contract if:

  • Application for Accommodation Contract does not conform to these terms and conditions;
  • The Hotel is fully booked with no rooms available;
  • The individual seeking accommodation is deemed liable to engage in conduct against the law or contrary to public order and morality with respect to accommodation;
  • The individual seeking accommodation is deemed to be infected with a contagious disease;
  • The Hotel determines the provided user information (e.g. name, address, telephone number) to be untrue;
  • The individual seeking accommodation is deemed to be of extreme nuisance to others;
  • The Individual seeking accommodation is heavily intoxicated or behaving abnormally, and engages in conduct which jeopardizes smooth operations of the Hotel or becomes a nuisance to others;
  • Accommodation is by minor(s) alone without parental or guardian consent;
  • Application for Accommodation Contract is made for the purpose of assigning the right of accommodation to others;
  • The individual seeking accommodation is deemed to belong to any one of subparagraphs a) through c) below:
    • Anti-social forces including organized crime group set forth in Article 2-2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter “OCG”), member of OCG set forth in Article 2-6 of the Act (hereinafter “Member of OCG”), quasi-member of OCG, and those having a relationship with OCG;
    • Entity or other bodies of which the business activities are controlled by OCG or Member of OCG; or
    • Entity having officer, employee, or other individual concerned who is a Member of OCG;
  • A violent or intimidating demand or a demand to assume an unreasonable burden is made against the Hotel with respect to accommodation;
  • The Hotel is unable to offer the use of its facilities due to natural disaster, facility failure, or other inevitable causes;
  • Designated by the law or ordinances of local government; or
  • Under any other circumstances determined by the Hotel to interfere with the management and/or operation of the facilities.

●Cancellation of Application for Accommodation Contract(Article 10)

  • A cancellation charge pursuant to the policy given in Annex 2 shall be charged to the applicant of Accommodation Contract (hereinafter “Applicant”) in the event that Accommodation Contract is cancelled in whole or in part.
  • If the Applicant does not appear without any prior notice by 8:00 p.m. on the date of accommodation (or one hour after the expected arrival time, if clearly indicated in advance), such Application for Accommodation Contract shall be deemed to have been cancelled by the Applicant and be subject to cancellation charge equivalent to cancellation on the date of accommodation.
  • Cancellation charge set forth in Clause 1 shall not be charged if it may be verified that cancellation pursuant to the preceding clause by failure of Applicant to appear without notice, is due to non-arrival or delay of train or airline flight, or other reasons not attributable to Applicant.

(Article 11)

Except as stipulated otherwise, Application for Accommodation Contract may be cancelled:

  • Under one of the circumstances set forth in Paragraphs (1) – (14) of Article 9;
  • When particulars set forth in Clause 1 of Article 2 are not provided before the specified date; or
  • When requested payment of security deposit is not made before the specified date.

(Article 12)

The Hotel may cancel the Accommodation Contract if:

  • The Guest is determined to be a member of, or otherwise in a relationship with, OCG as set forth in the Act on Prevention of Unjust Acts by Organized Crime Group Members and ordinances of local government or concerned bodies thereof, or other anti-social forces;
  • The Guest engages in, or is liable to engage in, the act of violence, intimidation, extortion, unjust demands, gambling, possession or use of drugs/firearms/edged weapons and the like, nuisance to other guests, or other conducts against the law or contrary to public order and morality within the Hotel premises;
  • The Guest is clearly identifiable to be infected with a contagious disease;
  • Demand to provide a service beyond reasonable level or to assume an unreasonable burden is made against the Hotel with respect to accommodation;
  • The Guest damages/loses/takes without authorization, building/facility/furniture/borrowed or rented equipment inside and outside of the Hotel;
  • The Guest engages in a conduct which would adversely affect fire prevention/firefighting efforts, including smoking in bed and tampering with firefighting equipment;
  • The Guest assigns or sells, or attempts to assign or sell, whole or part of the right of accommodation;
  • Accommodation Contract is concluded through a travel agency, and payment of Accommodation Charges by said travel agency has not been confirmed.
    Payment is also deemed unconfirmed when it has been made by transfer just before the end of business hours of the financial institution or through internet banking irrespective of the business hours of the financial institution, but the fact of such transfer may not be confirmed on that day because the day following the transfer was a bank holiday;
  • The Hotel is incapable of providing accommodation due to natural disaster, facility failure, or other inevitable causes;
  • The Guest fails to observe House Regulations of the Hotel; or
  • Designated by the law or ordinances of local government.

●Refusal of Continued Stay(Article 13)

The Hotel may refuse continuance of accommodation regardless of the length of stay once accepted:

  • Under one of the circumstances set forth in Paragraphs (1) – (14) of Article 9; or
  • If the Guest fails to observe House Regulations of the Hotel.

●Observance of House Regulations(Article 14)

  • The Guest shall observe the House Regulations of the Hotel while in the premises of the Hotel.
  • The Hotel shall not be liable for any damage and/or lost profits suffered by the Guest for not observing these terms and conditions and House Regulations.

●Responsibility for Parking(Article 15)

  • The Hotel is simply offering a parking space when the Guest utilizes the Hotel parking lot, and assumes no responsibility for taking custody of the vehicle of the Guest, regardless of whether or not key to such vehicle is left at the front desk for safekeeping.
    The Hotel shall not be liable for any accident involving damage to parked vehicle or human injury.
  • Please do not leave valuables or other articles in the vehicle while parked at the parking lot. The Hotel assumes no responsibility for any articles lost or stolen in the parking lot.
  • The Hotel may refer the Guest to a contract parking when the Hotel parking lot is full. The Guest is asked to observe charges, regulations for use and other terms of use of contract parking as they differ from those of the Hotel.

●Liability of The Guest(Article 16)

The Guest shall compensate the Hotel for damages sustained by the Hotel as a result of willful act or negligence of said Guest. The Hotel shall further claim the Guest for its lost profits resulting from cessation of use of facilities due to such willful act or negligence of said Guest.

●Custody of Baggage and Belongings of The Guest or Articles Left Behind by The Guest(Article 17)

  • Belongings of the Guest brought into the Hotel prior to the arrival of said Guest shall only be taken into custody if the Guest contacts the Hotel in advance and the Hotel consents to it. The Hotel does not pay freight charges for any such baggage, etc. on behalf of the Guest. The same shall apply to postal/courier packages delivered to the Guest.
  • As a general rule, belongings or articles left behind by the Guest after check-out will be kept for a period of three (3) months counting from the day that such belongings, etc. are found
    Belongings or articles left behind of which the safekeeping period has lapsed will be disposed of.
    Any article, foodstuff and beverage left in the refrigerator, as well magazine and anything liable to rot or change in quality will be disposed of at the option of the Hotel.
  • The Hotel is entitled to inspect the contents of belongings or articles left behind to enable appropriate handling in accordance with the nature thereof, and to return such belongings, etc. to the owner or take measures pursuant to the preceding clause as required; the Guest shall not be entitled to object to these procedures.
  • As a general rule, the Hotel will not call the Guests (or the person to whom the articles belong) for articles left behind
  • The Hotel shall not be liable for any damage and/or lost profits resulting from the provisions of foregoing four clauses.

●Use of the Internet(Article 18)

  • Upon using the in-house internet service, the Guest shall be solely responsible for protecting/maintaining security of connected PC, cellphone and communication terminal.
  • The Hotel does not provide technical support for terminal environment and/or various settings unique to the Guest.
  • Please be reminded that depending on the location of the Hotel, there are areas where the waves do not reach or waves are not strong enough to use.
  • In-house internet service is not guaranteed as to the use thereof.
    The Hotel assumes no responsibility for malfunction, loss, and lost profits associated with:
    • Incapability to use the internet by reason of terminal, software, or setting thereof used by the Guest;
    • Virus infection, lost data, or unauthorized access;
    • Unauthorized use including transmission of spam mail, use of file sharing software, transmission of suspicious packet, and use of port;
      The Hotel will discontinue provision of the internet service if such use is detected.
    • Reduction of data communication speed caused by simultaneous use of the guest room internet service by a large number of guests;
    • Interruption of communication service due to system failure or other reasons; and
    • Incapability to use the internet by such cause as trouble in the communication system of the Hotel or communication failure of the service provider.

●Governing Language(Article 19)

This Terms and Conditions of Accommodation Contract may be drawn up in English or other languages in addition to the Japanese language; provided, however, that the version in the Japanese language shall prevail in all respects in the event of any inconsistency or discrepancy between the Japanese version and version written in another language.

●Jurisdiction by Agreement(Article 20)

  • Unless otherwise stipulated, this Terms and Conditions of Accommodation Contract shall be governed by and construed and applied in accordance with the laws of Japan.
  • Any judicial action arising in connection with this Terms and Conditions of Accommodation Contract shall be submitted to the exclusive jurisdiction of the Nagasaki District Court, the court having jurisdiction over the location of the Hotel, in the first instance.

Note:
 1.The basic accommodation fee is based on the price list posted on the Hotel website.
 2.The Hotel charges children the same amount of accommodation fee as adults, but there is no charge for children under elementary school age to whom bedding and meals are not provided. However, child fees and infant fees may be set depending on the season and accommodation plan. In such a case, we will notify Guests in an appropriate way.
